This article is like comparing apples to oranges. Arthur is dead. Obama is alive. It is too late to remove Arthur from office, but Obama is another story. I personally can see both sides of the agreement. With Obama's money and political connections it is entirely possible that the Hawaiian birth certificate is fake as well as the new paper accounts of his birth in Hawaii. Most everything is done with computer now and easily manipulated.
On the other side of the coin is the possibility that he is a legitimate natural born U.S. citizen and we are stuck with him until January 2013.
It is a no win situation for this country either way it comes out. Find actual hard evidence he can't legally be POTUS and face he very real possibility of nationwide race riots, the kind that would make Watts look like a small street fight. Or, prove he is legally our POTUS and have to sit by and watch him financially destroy our country for the next 3 plus years. Personally I say we give him enough rope and let him hang himself (metaphorically speaking that is). Then in 2010 we weaken the tree that is supporting him by voting as many Democrats in Congress out of office as possible and in 2012 we send him a message that even he can't ignore by voting him out of office. Here in Nevada the "Senator Harry Reid" tree is dying fast and I can only hope California has not gone so far to the left that they can't see that Pelosi is nothing but a power mad witch who cares nothing about California. Getting rid of those two will be a very good start and send a powerful message to Washington.

I am a registered independent and would very much like to see both the Republicans and Democrats lose power in Washington and be replaced by people who listen to those who voted them into office. If you are referring to the 'logic' of the MSNBC story - you might want to do some research on your own and not rely entirely on the partial story written by the AP.
They failed to give you the whole story. The FACT is that Arthur lied about more than just his birthdate. He lied about his mother never leaving the US, the date his father naturalized, and the port at which his father entered the US.
The author of 'Gentleman Boss' seems to think it is commonplace for someone to lop off a year just for vanity reasons. If I'm going to change my birthdate, due to vanity reasons, I'm going to lop off a LOT more than just 1 year!
The AP's lack of integrity goes even further when they fail to mention that since Arthur's father had not naturalized PRIOR to Chester's birth, ole Chester was - just as Obama was - a British Subject at birth! Chester needed to muddy the waters with all the misinformation because he knew - as a British Subject - he was ineleigible to be VPOTUS.
It is this type of 'logic' to which you are referring? I'm not sure who 'started it' and don't really care. I do respect the office of the President; I just have a hard time respecting a man who, I believe, KNEW was inelegible to be POTUS prior to running. I don't need to name any names or quote any fringe media - the facts speak for themselves. I perfectly well know that Obama is the president. I also know that it is not about Obama - it is about the precedent he is setting and who is allowed to come after him. If you could look past the trees into the forrest, you might be able to see that as well. (meaning, if you would stop trying to defend a man who needs no defending, you might be able to see the whole picture).
Obama is setting a VERY dangerous precedent - but Chester did not. The historical discussion was about Chester's Canadian birth - which was a smokescreen for the real truth. There was NEVER any discussion about his British citizenship disqualifying him for the office; therefore, no precedent was set by Chester's presidency. This issue was only just brought up within the past year. No precedent can be set by a lie that was unknown back when he was running.

Sounds like you're getting your "facts" from the intellectual sewer that is Leo Donofrio.
But stop and think about a few things Donofrio is asking you to believe:
(1) The Founding Fathers, when drafting the Constitution, abandoned hundreds of years worth of common law on the meaning of "natural born subject," which was the origin of our term "natural born citizen." (It meant birth within the realm, or what is known in legal terms as jus soli.) Yet the Founders never said a word about it. (The contemporary courts must not have been in on this big secret, because they continued to divide all citizens into natural born citizens and naturalized citizens as before. There never has been a third category.)
(2) Even though people concerned about Arthur's status as a natural born citizen in 1880 overwhelmingly if not exclusively focused on his place of birth, Arthur knew better than everybody else. And Donofrio has figured it all out, without the slightest evidence that Arthur suscribed to this interpretation of natural born citizenship.
(3) In some incomprehensible case of political jujitsu, Arthur was willing to have people believe that he wasn't born in the country, just to protect the date of his father's naturalization. But then he lied about his father's background on virtually everything but the date when his father was naturalized. (Arthur never claimed any date at all, and Donofrio hasn't alleged he did.)
(4) Arthur nominated judges to the Supreme Court who were fully in on this secret conspiracy, and ruled in Wong Kim Ark in favor of jus soli on the belief that all laws and appointments from the Arthur administration would be void if they acknowledged the "truth." (Too bad the dissent in Wong Kim Ark never outed this conspiracy.)
(5) The AP knows about this, too, and they're in on the secret by diverting attention to where Arthur was born.
If anyone thinks the above assumptions are more than a little crazy, they're not alone.

A Republican's question of birthplace is excepted as an American as President Arthur took office and the Country moved on with anymore attention to the subject. Now it's clear Obama was born in the US but two reasons cause problems. One he's a Democrat and the second he's Black. Even if there were a video tape of Barack Obama's birth in the hospital Republicans would still say he wasn't born in the USA. Some Republicans go so far as saying Hawaii wasn't part of the United States 47 years ago as all Law Makers celebrated Hawaii's 50th year as being part of the USA. This allows the Foreign Leaders to know US Law Makers can't count. Obama was born two years after the Hawaii became part of the United States of America. But many people still believe what the Republicans say.
Even if Jesus came down and verified Obama's birth certificate in front of them they wouldn't accept it. Nothing will satisfy them.

I don't know why many of you keep metioning the issue of when Hawaii became a state and only then becoming a part of the US. Hawaii became a part of the US when it became a territory in the 1890s and Alaska when we purchased it from Russia in the 1860s. Guam, American Samoa, Puerto Rico and the US Virgin Islands are all part of the US as well and if you were born there you would be a US citizen also. Being a state is not all that is relevant to being a part of the US; incidently Washington DC is not a state either. Is the national capital not part of the US either?

Hawaii uses a form very similar to what most other states do now, due to the restrictions of mention of private individuals and places on publicly distributed documents - hence, the development of short-form birth certificates which conform to all privacy laws passed since the 1980's.
According to the Constitution (you know, the part about States' Rights?), all states are entitled to design their documents any way they want unless there is a federal law to the contrary, which is why marriage certificates, divorce decrees, birth certificates, death certificates, and even driver's licenses do not all look alike.
Hawaii has issued their version, and their law does not allow issuance of anything else. They are a Sovereign State, so under State Reciprocity, which is also in the Constitution, if you are an American Citizen of any other Sovereign State, you must accept Hawaii's decision.
The Sovereign State of Hawaii has spoken. The case is closed.
(And by the way, Obama has not spent a cent on this nonsense. The lawyers involved have said publicly that they have considered a joy and privilege to do this PRO BONO. It is the obligation of the Secretary of each State to vet and certify the credentials of ANY Presidential Candidate in order to accept his/her legitimacy to run for the POTUS! NOT ONE STATE HAS DONE SO!! And each and every citizen constitutionally has standing to question ANY candidates qualifications for POTUS!
A claim by an low-level public servant is NO PROOF OF CITIZENSHIP OR NATURAL BORN STATUS!
In the case of Berg v. Obama, US Federal Judge Richard Barclay Surrick agreed with Obama's lawyers and ruled that Berg, as a citizen, as a voter, has no "standing" to enforce the United States Constitution. I have read that other agencies have asserted that only another presidential candidate has standing to sue respecting the qualifications of a candidate, presumably because, arguendo, only another presidential candidate could be injured (lose an election) as a result of a non-qualified candidate on the ballot.
This may be the most patently absurd, illogical, incomprehensible, astonishing, mind-boggling, and utterly stupid argument I have ever heard in my life – and from a Federal Judge, at that. And if I didn't make myself perfectly clear, let me know and I'll try again.
Let's do the analysis.
1. The U.S. Constitution is a CONTRACT between The People, The States, and The United States, the federal government, that defines and limits the role of the federal government, and the rights of the States and The People, and, among other things, defines and limits the qualifications for president, i.e., that the president must be over the age of 35 years, and must be a natural born citizen.
2. Any party to a CONTRACT has standing to enforce it. This is as basic as it gets. Contract Law 101. First week of law school stuff. And it seems that lawyers and judges all over the country have forgotten all about it. Also, the Constitution was intended to benefit all American citizens, We, The People, and in basic contract law the intended beneficiaries of a CONTRACT, i.e., us, also have standing to enforce it.
3. If We, The People, do not have standing to enforce the CONTRACT, the U.S. Constitution, then it is unenforceable, and if it is unenforceable it is just a historic curiosity that means nothing. It's just an old piece of parchment. But that was not the intent, and to give intent to the CONTRACT it must be enforceable by its parties and beneficiaries.
4. We, The People, have standing under the First Amendment "to petition the government for redress of grievances." If we have a grievance that a non-citizen, unqualified, or illegal alien has seized the POTUS, I think the First Amendment unequivocally gives every American citizen standing to sue the government to redress of grievance and ENFORCE THE CONSTITUTION.

Obama did not have to show anything. Nothing in the Constitution says the candidate must show anything at all. It simply says he must be a natural born citizen and of age. That duty has fallen to the state of his birth to present said proof. The State of Hawaii, not the just the Health Secretary, but the Governor, a Republican one at that, and a State Seal from that Sovereign State, and a decision from their Supreme Court, meet the Constitutional requirement.
The United States Legislature has unanimously upheld that, even including Michelle Bachman. The Supreme Court and all lower courts have said every challenge was without merit.
None of the other documents anyone has mentioned (his kindergarten records, for Pete's sake) are required or even mentioned in the Constitution. His relatives in Kenya, if you read the correct translaion, say he was born in Hawaii but is a "son of our village", not that that matters either. Again under Article IV, Section 1, each state may issue what ever document they wish, as long as it is certified by their Governor (who was a Republican), it contains the official state seal, and it was even further validated by the Hawaiian Supreme Court.
The laws of the State of Hawaii and most other states, after the passage of the privacy acts since the 1980's which prohibit publishing documents containing the names of any private citizens who are not also elected officials, no longer issue long-form birth certificates, which contain the names of doctors, nurses, witnesses, etc. Even if they released it, all that would be blacked out in order to not break these laws, and you would see exactly what you are seeing now.
You also have wasted a year of your life on this, and that is a year you can never get back. I have also had the candidate I voted for lose an election, and like John McCain, a man I have always admired, I simply went to work for the one who won. It is a shame that you cannot imitate John McCain's dignity and move on.

They will give you nothing because they do not have t - they are private, so they get to make their own rules. Go to Illinois and ask for all his Senate records. As I said, the state of Hawaii, and many other states, all use short forms in order to comply with the federal privacy laws. All data is now electronically stored now in many states. I had to get a copy of my birth certificate (not from Hawaii) for an upgrade to my security clearance ( lost my original for a while, the one with the baby footprints on it) and I received one that looks almost exactly like Obama's. Other people I know have received the same. Even if they could recreate the original paper and print out the long form, they would be required to black out all but the information on the short form, so what would be the point?
As to other documents, they are not required by the Constitution, People are just wasting, at this point, a year of their lives they can never get back, when even John McCain, a man I have respected for years, has moved on with dignity and joined the loyal opposition. I have worked for administrations when my candidate has lost. It is not difficult to realize that that is why we believe in "one nation under God, indivisible", regardless of who wins any given election.

Hawaii released a certificate of live birth, not a birth certificate. Obama could clear this up especially since he claims to run a transparent operation. Yeah. And the rumor that Hawaii birth certificates were burned is farce too. They are all on microfish. His mother's and father's timeline don't add up to a birth in Hawaii. The term "Czars" was first used under the Ronald Reagan administration, almost as a joke. Their actual official job title is Special Adviser to the Whatever Committee. These are committees with special advisory tasks which do not merit Cabinet status because their tasks are specific and temporary, except on occasion, like the Department of Homeland Security, which started out as an advisory council.
Every president since Reagan has called their committee advisers "Czars". There is nothing new here.

Conspiracy theories are as old as the human species' intellectual development. In earliest days, they were more along the "superstitious" line - the attribution of magical powers to things not clearly understood or easily explainable.
The people susceptible to these things, then and now, are motivated by fear and a lack of control. Personally, I think the 9/11 conspiracy is just as easy to debunk as the illegitimate President Obama one. Both were motivated by a feeling of loss of control after a particularly cantankerous election, and an additional need to discredit that election as much as possible. In all probability, both groups will cling to their beliefs even in the face of indisputable evidence to the contrary, not only because disproving a negative is almost impossible, but because it allows them to look away from something they cannot explain or really understand ("we are at war in Iraq when we were told we were going after bin Laden who attacked us?" and "we are experiencing the worst recession we can remember and whose fault is it that it isn't fixed yet?"). We still have the people who believe the "second shooter" conspiracy from the Kennedy assassination
But all of these people are noisy, annoying and a waste of constructive manpower, but they are also impotent in their conspiracy mind-sets, which just increases their frustration and makes them more useless to their society as a whole.

Personally I'm fed up with both parties and their more rabid followers. I think both former President Bush and President Obama have lots of legitimate criticisms that can be leveled against them, but all I ever read about is silly conspiracy theories about stuff like birth certificates or 9/11 attacks. I agree with you 100%. I have many, intelligent, educated conservative Republican friends of many decades, and they think this is all nonsense, because they do know the Constitution and applicable laws.
We know, realistically, that this has to be small group of people - for Pete's sake, a recent survey showed that many of these "birthers" in one state don't even believe Hawaii is a state now!
We need two parties (or even three or four) in this country. We need a loyal opposition. I am positive that the majority of people who are registered Republicans, and even those elected to Congress, state positions, and even more local ones, are supporters of the Constitution and are not part of this small group being led by a few political "has-beens", wannabees, and entertainers.
What I do not understand is why these people are so afraid to speak out. Surely they can see their party being hijacked by this little group of non-elected people. Actually, there have been interviews with his old classmates, including a long one that aired several times with the girl photographer who took a whole portfolio of really interesting pictures of him at Occidental. There was also an interview with one of his senior professors at Columbia. And there have been numerous others.
I am sorry you have missed so much. I find it is helpful to watch or tape a lot of news shows, including a lot of opposing views. Your TV has multiple channels. I would recommend using as many as possible.

Actually, we already have a law covering our military bases, if one of the parents is an American citizen in the service of this country. There was also a little known clause which covers children born on non-U.S. soil under the same conditions, since McCain was actually born at a hospital across from the base, not on it.
Hillary Clinton and Barack Obama went to the DNC at the beginning of the election so the Democratic leadership would defend McCain's right to run as a natural born U.S.citizen, in order to discourage all questions later in the race.
So what would they do now if Arthur was born in Canada? Overturn any bills he may have signed into law? This issue is in the who cares category since he was president more than a century ago. Probably stirred up by someone who wants someone like California's Austrian born governor to be eligible to run for president. As for Obama I have no doubt he was born in Hawaii, to many people knew him over there.

Also, under current laws, if you as an employer request such documents for employment and then release them to the general public, you will be breaking the law. I do not think Obama or anyone else in the government or the media is inclined to do this. His senior professor at Columbia who spoke about him as a student, what kind of work he did, and what grade he got in that class, was pretty close to the edge, but it was his choice. So I guess it would be okay to track down all of his professors and get the information that way.
If a lawyer can go to all the trouble to say she traveled to Kenya, but returned with an Australian birth certificate template, composed with the name and insignia of a country that didn't exist in 1961, and city which was not in that country, and then present it as authentic proof, and you are all so ready to accept that, then why can't she also track down all his professors and force them to confess whatever you all want to know?

Agreed....My parents are US citizens, I have always been a U.S. citizen since birth...a birth that occurred in France. Does that make me ineligible for the Presidency?!?!?
And what about the first bunch o' presidents?!?!? They were all British citizens? Washington, Adams, Jefferson....born on American soil, but British subjects....so what's that all about.

I beleive the law states a candidate cannot be born on foreign soil.

You are incorrect. Our laws cover this. We have many citizens overseas on government business. They can have their babies anywhere they wish, and the child is still a natural born citizen. McCain was born in a hospital which was in Panama and not on the military base. However, because he had a parent overseas on government business, he was automatically a citizen. As a matter of fact, Hillary Clinton, Barack Obama, and the DNS all made public statements concerning this issue when there was first a question of McCain's legitimacy during the early days of the campaign. It stopped immediately.
We also have laws covering citizens traveling overseas, as long as they do not declare an intent to stay, or go to work for a foreign government. Their children born abroad are also natural born American citizens.

3. I bet most of the hillbilly rednecks who voted for Bush haven't read it and THAT's where you get people electing someone who most definitely is not qualified for the office.
American citizenship is acquired in three ways: (1) being born in the United States (includes the states and territories) according the 14th Amendment; (2) being born in a foreign country if one or both of the child's parents are U.S. citizens (legal principal called jus sanguinis); and (3) naturalization. Catagories 1 and 2 make a person a natural born citizen and thereby eligible for the Presidency. Based on catagory #2 it doesn't matter whether a person (including President Obama) was born in Indiana, Hawaii, New Zealand, Kenya, or anyplace else, the fact that his mother was a U.S. citizen makes him a natural born citizen and qualified to be President. Obvioiusly, none of the people bringing up this suppossed impediment to the President's qualification to hold office have done any basic research into what makes a person a natural born citizen..

I was born in the USA as well as my parents and because I am a Muslima who wears a scarf on my head, you don't know how many times NEW IMMIGRANTS with thick russian and thick italian accents yell at me at a red light: "Why don't you go bakka to you cu*ntry!" at which point, I SOMETIMES yell back: "Philadelphia's a long way to walk, you moron."

I have never heard of "birther" before President Obama came into office. I feel it is HATRED FOR ISLAM which triggered this whole stupid citizenship fiasco.
