Remember, this prison was established so that the Bush Regime could evade both U.S. and international law. Quite a good number of the prisoners there have been found completely innocent of any participation in terrorist attacks or organizations, but it was simply too inconvenient to deal with a continuing injustice, so they stayed there for years. Under either U.S. law or international law, that would not have been allowed. The judge issuing this ruling is courageous.

I am disappointed that so much hullaballoo was raised about transferring the prisoners to one of many very secure and underused (in one case, brand new and never been used) facilities in the mainland U.S. The closing of this "black hole of Calcutta" at Guantanamo is very important.

It is amazing that someone seriously claims the Gitmo prisoners are "POWs" covered by the Geneva Convention. In fact, it was specifically to create a kind of legal limbo for these captives that Guantanamo was set up. They are termed "enemy combatants," not "prisoners of war." The Justice Dept. during the Bush Regime most papally decreed that the prisoners are not, and would not be, treated according to Geneva Convention standards (and they are NOT treated thus). Access to them is very strictly limited, and the International Red Cross has made quite a stink about that.

The sentences of the Gitmo prisoners most assuredly has NOT been defined, either. Hundreds of those guys have yet to even hear what charges they will ultimately face - the U.S. Constitution's requirement for a "speedy trial" hasn't been extended to them despite judicial rulings that have tried to place these prisoners under that umbrella.

Crazy, I've agreed with you so far, up until now. Certainly they have the right to build in this spot, legally and constitutionally. However, Prof is certainly right in that this community center is provocational and in poor taste. I think its more to the manner of the feelings of the survivors than to the dead! Furthermore, if the goal is to propogate religious tolerance and understanding, the Cordoba foundation would have selected a less objectionable site. The mere choice of location suggests, to me, that cultivating a relationship with the community (beyond the muslim community i mean) is not a true goal of the project. Its unfortunate and sad that such blanket hatred has been the reaction of so many, but certainly it was to be expected. I only hope that if and when the project is finished those people running the community center will actually focus on outreach, education, and cultivating understanding and positive relationships.

I have stated and will state again, that even if we have 99.99% of the people in this country say it should not be built there, the group that wishes to build it have the right under our constitution! Sorry, POW's are not covered by our Constitution. Special military courts go back to those who tried to kill Lincoln, Stanton established military courts to try them, these military courts are legitimate as proven by court cases, however, the sentence is what was appealed. Let's hope the gov't will appeal to the circuit court of appeals just as was done in CA last week. Rational and education is a subjective term.
