Rahm won't waste this crisis. This will be his "reason" to rejoin the Obama Admin as a courts Czar. That way he will be able to review all of the judge appointments to make sure any new judges are right (excuse me, LEFT) minded.

None of this will really matter though, the IL Supreme Court will overturn this one pretty quickly. He never formally changed his place of domicile, voters registration, drivers license, etc. His job was in D.C. and commuting each week is out of the question.

Hey Lebron-Just a tip the rules are clearly stated that ANY candidate MUST live in the city in the year (meaning all 365 days of them) before the election period. It is NOT racist it is a rule for every single person that wants to run therefore it is NOT racist. The fact remains he no longer resided in any way in Chicago for the two years prior to the election the reasons do not make any difference the rules are clear. Would you be crying racist if the person was white no you would be whinning that if the courts allowed it it would be because the person was white. You can't have it both ways. The prior decisions allowing him to be on the ballot were racially bias allowing someone of color to bend the law. I can just about bet that if the person was white those other decisions would have been final and you and others like you throwing the race card would be saying "good they shouldn't bend the rules".
@Sandrich-once he rented out his Chicago home with a legal lease to another person and lived exclusively in DC for two years with NO residence in Chicago his residence became DC period. The fact is his new address went on his w-2 forms period he did not receive mail at that Chicago house he moved his entire family to DC maintaining zero connection except a rental house in Chicago. If you went to apply for in state tuition he wouldn't get it in Illinois. To be considered a resident of any state you have to live there from a minimum of 6 months up to a year to get in state tuition. You have to have a drivers license, voter id card and utilities in some form or fashion to be a resident. He was not. He shouldn't have rented the house out and should have periodically gone back to stay for a week or two or had his family stay there while he traveled. The rules are the rules just because he is a person of color does not mean the rules should be broken, if he was white you would be saying good he shouldn't be on it.
So when he moved to DC in 2008, while Chicago was described as the 7th worst housing market in the country, he didn't even try to sell his home. As I understand the situation he was able to rent out the home in 2008 renewed the lease in 2010 and then tried to back out of that agreement only when he understood Dailey was not going to run again.
So it seems had Dailey planned to run for Mayor Rham would have resigned himself to serve at the pleasure of the President, well that is until something better for him came along.
He will get on the ballot, it has been proved time and again that law does not pertain to the rich of this country, like it does for the average American.
This is a ruling that almost certainly will not stand. The reason that countries have federal districts that are not states are so that they do not interfere with residency requirements. If you are a federal employee in the federal district (Washington, DC) then you still have the same residency you had before you started working there. Many Congressmen, especially in the House, simply cannot maintain two full households because the pay is not high enough and especially those from high-cost-of-living states or districts. Many of them are forced by practical economics to rent their homes while their family is in the DC area, while others choose to rent in the DC area while keeping their home available for trips back. Still others leave their families at home and sleep in their offices.
But courts have heard challenges based on residency over and over and have always ended up saying that a person in federal service and working in DC maintains the same residency that they had before they began working there. The same applies to the military. Your residency when you get out of the military is that same as when you entered unless you have officially changed it. This is how so many people, such as Colin Powell, can come out of a service career and not have to deal with establishing residency.
Unfortunately, judges are often political appointees and have political "debts" to pay.

Not a win, a loss. Instead of the people getting to decide if they want him or not, some slimy individual's who are trying to circumvent the democratic process, have denied the people of Chicago their voice. Since Illinois law allows for people to serve in national government without losing their Illinois residency status, it can only be that the Appeals Court is execising a non-judicial agenda. The people should vote him out or in. It should not be decided by some legal trickery.
Rahm making an Appeal to higher Courts is just like all others. It is to save face. Eventually this news disappears, never having a Court hearing.

The appellant courts reasoning is just pure US politics. Stupid use of time and money. Odds are this ruling will be reversed and he will run. Additionally, after all this he will be the odds on favorite to win. Damn stupid tactic by those who are trying to stop him.

The Law states a candidate must maintain OWNERSHIP of a local residence when away due to employment requirements [and maintain a voting record AND vote, which he did]. Emanuel leased his residence and didn't pass title with the leasehold he entered into. This ruling will NEVER stand, never, trust me.
C'mon, y'all---this is only an issue because Emanuel's a Democrat. I'm not a fan of his, but I'm not going to deny him the rights due any person serving their state and their country in D.C. Some of you seem to ignore the fact that before accepting the job in Obama's administration, Emanuel was an elected U.S. Representative for the State of Illinois. His residency in D.C. was directly related to his service in Congress. He did not buy a permanent residence in D.C., and he maintained a residence in Chicago, leasing it out while serving in Congress and the Obama Administration. Therefore, he was still legally a resident of Illinois. You can't rewrite the laws to suit you own poltical prejudices.
Using the logic some people are applying, any Congressman or Senator who buys a house in Virginia or Maryland while they're serving in D.C. has relinquished their home state residency and is serving illegally. That includes a number of Republican members of Congress--so you might want to rethink your position on this. I don't think the Constitutional revisionists are ultimately going to win this one.
It is good news for the citizens of Chicago. It is time that politicians have to prove that they live and work where the people they want to represent live and work. Prove that they aren't some special ruling class. Prove that they can be ordinary citizens like the neighbors they are asking to vote them the liberty of feeding at the public trough.

I live in CA and own two rental homes that I once lived in. Both are in different counties than the one I currently live in. I am not allowed to be a registered voter from either of those two counties I don't currently live in, so I can see how something as similar to this might apply to Rahm even though he's in a different state than me.
On another note, after reading his Bio. I see that he has not held any real job where he would have developed the skills necessary to run something as complex as Chicago city government. Just like his, Barry in that respect.

You seem to be forgetting that if they use this on a Democratic incumbent and get him thrown out, that a Republican or Independent will get in! Then it will be used against that party the following election.

To me this issue is pretty cut and dried. The requirements to run for mayor are clear. You must have lived in Chicago for at least a year prior to the election to run. Emmanuel lived in Washington, not Chicago. He did not maintain a home in Chicago and did not reside there.
The facts that he was in Washington to serve the president and that he intended to return are irrelavent. The requirement is clear, and he didn't meet the requirement.
This is a victory for the rule of law. We have become a nation that is too quick to suspend the rule of law if something else seems to "make more sense" to us. Emmanual certainly knew the law and chose to gamble that he could get a "deferral" from it. Good for the court for sticking to the rules. It's nice to see the law prevail.
@becsmom-Apparently you don't realize each and EVERY single one of the candidates past and present have to meet the standard not just democrats. This is not about race, social standing, religion, or political affiliation. It is about the set rules and standards each candidate must meet to be allowed on the ballot period. The facts as they are he did NOT reside in the city of Chicago for the 365 days coming up to the election so he is NOT qualified and does not meet minimum standards for residency. The only reason people are whining is because he is a minority and apparently they shouldn't have to meet the minimum standards. So if he was a white man, aged 55 and a republican you would be saying it's ok. I doubt it you along with the rest of the libs would be screaming foul. You can't have it both ways. The race card can no longer be thrown as a black man and his family now reside in the white house. On the other hand, I'm wondering how this would apply to military personnel? Would they be held to the same rules if they were stationed somewhere outside of the Chicago Ctiy limits? Not stirring the pot or taking a stand on this question, just curious to know how it should go under those circumstances. Keep in mind that even holders of public office are allowed to vote from their home precinct as evidenced when Barry and others went home to vote in November, 2011 as all federal elected officials do. Is the voting law and qualifications for holding local public office the same regardless if the person is elected or appointed?
This is not based on state or federal law, it is Chicago city ordinance that mayoral candidates must live in the city 365 days before the election. The arguement was made that if Rahm can run, then all the firemen, policemen, teachers, city workers, etc. who are required to live within city limits by city law would be able to leave the city and keep their jobs if they just rent their houses and say they "intended to return someday". Believe me, these people would love to move out and get their children out of Chicago public schools, stop paying Chicago city taxes and the new Cook Co sales tax.
The printer has already said the ballots are going to print without Rahm's name one them as today's court desicion is the current rule to follow. The ballots need to be printed and distributed to the polling places soon. This means Rahm can only get on the ballot now as a write-in since the election is Feb. 22. He may not even have time to file as a write-in because the election is so close.

@tiny-exactly my stepson now a marine was a correctional officer for the country in the state he lives in and he was required by that county to live within the county or lose his job.
@wpearson-as it relates to military personnel you have the same guidelines you must maintain a residence to continue voting in your state. If you are a single person you can list your parents address for that matter as your legal residence as long as you maintain receiving mail there as well and do not obtain a primary residence outside of that state/city/county. If you declare yourself a resident of another state by getting a drivers license or register to vote in another state your original state is no longer your residence. By law you as a member of the military can maintain a drivers license from your home state and your voting privileges but once you change them that's it you have to reestablish residency. So because Rahm changed his address, voting and is not military he would have been required to get a DC license he by doing that revoked his illinois residency. Temporary residency is listed as 6 months or less. Also I would guarantee he did not pay state income tax for illinois and that would be the nail in the coffin.......you aren't a resident if you don't pay state income tax. He would have paid property tax for the rental but not income tax on his large salary from DC. He would have had to pay tax then in both places which I am sure he did not given the people in DC tend to forget they are required to pay taxes like the rest of us. He most assuradly would not have paid in both places. So a quick look at his w-2 would answer the question as payroll doesn't deduct for two states for the same timeframe.
Based on this ruling, a military person would only be eligible to run if they had lived there for the 365 days prior to the election. The law is not in place to keep people from running, but rather to insure that those who run for elected offices are truly representing their geographic neighbors. The law seems to be enacted to insure that someone who is mayor Chicago has lived there for the year prior to being elected. This seems to make sense.
So, if this is the standard, then your invalidating all Military / Absentee Ballots as well because they do not live in the city. Please understand...I'm not talking about a military service member "running" for office...but rather voting. Why wouldn't the argument be the same...someone who is a legal resident of Illinois, yet is assigned to work at the U.S. Army Garrisin Ft. Stewart, Georgia, has no understanding of the local politics because of his military "out of state" assignment. Try to argue that one...you can't! So if there are rules for military veterans serving out of state, not maintaining a physical residence, or having their mail sent to that residence and still allowing them to vote...then the same should apply for Rahm Emanuel.

When you donate to the campaign of someone running for office, and then that person doesn't run for that office, can you get your campaign contribution back? If so, how do you go about that.....simply ask....maybe?

There is a clear difference in Chicago between being eligible to VOTE and being eligible to RUN for office. If your government business takes you out of Chicago the law states that you can still VOTE in local elections. HOWEVER, the law sets a DIFFERENT standard for being able to run for office than it does for being able to vote. To run, you must have physically resided there for the year leading up to the election (which may be different than meeting the residency requirements for voting, which does make some allowances for being considered a resident without actually residing there.)
For those who consider the rule of law to be important, it looks like the court got it right.
Supposedly, Rahm knew beforehand that his residency was an issue; yet, he ran anyway and brought it to this point. Why should the requirements that everyone else be held to get dropped for him? Because he worked for BO for 2 years? If he would have maintained his IL residency, this wouldn't be an issue. BUT, he converted it to rental property. I agree with others. At that point, he gave up his IL residency and became solely a DC resident. Granted, it's Chicago politics, but it is for everybody running. He should be held to the same standards.
Why is it that when Cheeeeney ran for VP, he was still a Texass resident,trying to hurry up and sell his home so he could say that he was from Wyoming,which he lived years ago.His home was not sold when he became VP(President),therefore, it proved that he was still a resident of the same state that GW was from.The law states that the Prez and the VP can't be from the same state.Rick Sanitarium lived out of Pa but said he was from Pa and even conned the taxpayers into footing some of his kids education.It's a way of life.

Emanuel was not in the military service. He volunteered to take a government job in D.C., just as my example of a city paid street cleaner may work in one city and live in another.

It'll be interesting seeing what the Ill Sup Court does with this. The appeals judges (the two that overruled the trial court judge) must have had some legal basis for that decision.
I don't like to think that at the appellate level judges would render decisions for political reasons. (although that did happen ten years ago at our US Supreme Court).
A legal resident remains a legal resident until an irrevocable decision is made to relinquish that residence. It usually requires that the resident actually intends to relinquish same or that he/she does something that is irreconcilable with continued residency.
A president of the United States does not give up his Texas residence or citizenship just because he lives in DC for 8 years.
The Court evidently relied at least partly on Emmanuel's renting out his Chicago apartment while he was in DC but what difference does that make? Pretty clearly he did not intend to become a resident of DC and he didn't sell the apartment.
Those of you who think it obvious that he gave up his residence better think about that a little more if, for example, you have a child who is attending a college out-of-state. Or is in the Army stationed in Afghanistan.
1st - Bush the president that went back to Texas, went back to the home he owned and had not rented out to another family.
2nd, if you go away to college and get a new license, you have set up a new residency. If you move your stuff out of your parents home and go to college, then they move out of state and rent their house, is that somehow still your residency even though you can't actually go into the house?
Emanuel tried to get back into his house and couldn't, I think that means he gave up residency.

Mayors must follow the election laws of the city they want to be mayors of, senate candidates follow the election laws of the state they want to run in for the senate. Chicago election law is residency 365 days before the election. State election law is 30 days. Works the same in New York where Hillary carpet-bagged as senator the way Keyes tried to in Illinois. (We didn't forget the sneaky Democrats either.)

Don't think the watchdogs haven't been vigilant. However................many underlings have gone down for corruption, down to the minor inspectors. I remember when a newspaper opened a bar and recorded the city inspectors who came in demanding bribes to pass the electricity, plumbing, health, safety, rodent control, flood control, gas protection (structural and human), pigeon control...you name it. Right, Gneisenau, Chicago does not let dead people vote, but many voters' addresses turn out to be empty lots, churches, schools, or beaches. Also not a few of these voters have birth dates before 1890, which in another city would put them in the Guiness Book of Records. Then there is the matter of disappearing ballot boxes. But that's only occurs in the few districts that are suspected of voting republican.

I lived in Georgia for a year once, I was totally miserable. It has its good points but tolerance was not one of them. I figured being from South Carolina it would be about the same but I am from Charleston which is a very tolerant city (Maybe because it is an international port and tourist destination) I remember being appalled at the people in Gwinnett and (I forget which one but a county just north of Atlanta) where they openly detested blacks. At people in my own office in Buckhead who made racist comments all the time. Just disgusting.

There are rules in every state for being elected to office. Hillary Clinton had to take up a residence in New York before she could run for office. Not that I am a fan of hers but the rules apply to all races period. There are age limitations as well as residency rules that apply to each candidate. For a congressional seat you must reside in the congressional district for a period of time before running for that and as for Senate you must reside in the state for a period of time. To be a state legislator there are the same limitations. Rahm is just trying to bully or whine his way through and hope that his liberal corrupt buddies will help him break the rules. I guarantee you that if say, he was alllowed on the ballot, won the election and then when the next election came up if someone else tried the same thing he would be fighting like hell in court to make sure they weren't allowed to run. You're comparing apples and oranges. The reason Hillary Clinton had to establish residency before running in NY was because prior to the her husband's presidency, she was a legal resident of Arkansas. If she had chosen to run for the Senate in Arkansas, no waiting period would have been involved.

Unfortunately, he rented it out until he wanted to run for city office. That negates his residency until he re-establishes it as he did Oct, 2010. There are many things in life that you MUST prove residency ... and to do so, rules have been created so that you can. Different circumstances require different lengths of residency ... the college:2 yrs in MA & registering to vote: usually 60 days nationwide.
I move to CA in 1980. I moved to CA in October. The federal presidential election was in November. Since my spouse and I would not meet the 2 month residency requirement to register to vote, we had to arrange for "absentee ballots" from MA since we were still considered MA residents for that election (not for tax purposes or anything else, but for election purposes to guarantee we were NOT disenfranchised). We also had to ensure our car insurance for CA residents was enforce within 30 days of "establishing" residency, which is the day we physically moved there.
Residency for election purposes is merely ONE OF MANY reasons anyone must establish residency. Chicago requires 1 full year minimum ... had he not forfeited his residency to rent his place out for 2 yrs and had maintained the cost of maintaining the residence in his name while working in Washington, he would have maintained his Chicago residency while working in Washington, DC. Do NOT give anyone crap that he is a middle class or blue collar worker either ... he has been making a substantial income as a politician for YEARS before even being tapped on the shoulder by Pres Obama. He made choices that were not good for his other choices ... and just like someone who over extends himself on a mortgage he cant afford, he must deal with the consequences of his choices. He isnt too big to fail that he needs special laws to "prop him up" while he makes the wrong decisions for his future choices.
I find it unique that my U.S. Representative owns a home three blocks from mine which his wife and kids live in year round. He travels back and forth when the House is not in session and maintains his residency here in his state from which he was elected. He also votes in the same polling booths we all do here.
There are any number of members of Congress whose families live with them in the DC area. Are you saying they aren't residents of their states and are serving illegally? Some of them have lived in the DC suburbs for years and rarely return to their home state "residences". Their children can get in-state college tuition in Virginia (where most of them live). I would think renting their unused homes would make both fiscal sense, and living in DC also would be healthier for the families that don't live within an easy commute. It is also pragmatic, since the cost of DC housing is astronomical.
I live in Chile and rent my house in Florida. I am a registered voter in FL and vote absentee. No doubt, Rahm Emanuel felt that he could not afford to forego the rent on his house. Chicago would have benefitted from his wisdom and connections. I know a lot of people do not like him because he is a "hardball" politican, but that strength would make him more able to keep Chicago at the forefront of the world.
All of the other candidates, put togther, do not have as much knack for brokering political solutions, making the hard decisions and standing up to other units of government (state, federal) for the people of the city.

None of this will really matter though, the IL Supreme Court will overturn this one pretty quickly. He never formally changed his place of domicile, voters registration, drivers license, etc. His job was in D.C. and commuting each week is out of the question.

Hey Lebron-Just a tip the rules are clearly stated that ANY candidate MUST live in the city in the year (meaning all 365 days of them) before the election period. It is NOT racist it is a rule for every single person that wants to run therefore it is NOT racist. The fact remains he no longer resided in any way in Chicago for the two years prior to the election the reasons do not make any difference the rules are clear. Would you be crying racist if the person was white no you would be whinning that if the courts allowed it it would be because the person was white. You can't have it both ways. The prior decisions allowing him to be on the ballot were racially bias allowing someone of color to bend the law. I can just about bet that if the person was white those other decisions would have been final and you and others like you throwing the race card would be saying "good they shouldn't bend the rules".
@Sandrich-once he rented out his Chicago home with a legal lease to another person and lived exclusively in DC for two years with NO residence in Chicago his residence became DC period. The fact is his new address went on his w-2 forms period he did not receive mail at that Chicago house he moved his entire family to DC maintaining zero connection except a rental house in Chicago. If you went to apply for in state tuition he wouldn't get it in Illinois. To be considered a resident of any state you have to live there from a minimum of 6 months up to a year to get in state tuition. You have to have a drivers license, voter id card and utilities in some form or fashion to be a resident. He was not. He shouldn't have rented the house out and should have periodically gone back to stay for a week or two or had his family stay there while he traveled. The rules are the rules just because he is a person of color does not mean the rules should be broken, if he was white you would be saying good he shouldn't be on it.

So when he moved to DC in 2008, while Chicago was described as the 7th worst housing market in the country, he didn't even try to sell his home. As I understand the situation he was able to rent out the home in 2008 renewed the lease in 2010 and then tried to back out of that agreement only when he understood Dailey was not going to run again.
So it seems had Dailey planned to run for Mayor Rham would have resigned himself to serve at the pleasure of the President, well that is until something better for him came along.
He will get on the ballot, it has been proved time and again that law does not pertain to the rich of this country, like it does for the average American.
This is a ruling that almost certainly will not stand. The reason that countries have federal districts that are not states are so that they do not interfere with residency requirements. If you are a federal employee in the federal district (Washington, DC) then you still have the same residency you had before you started working there. Many Congressmen, especially in the House, simply cannot maintain two full households because the pay is not high enough and especially those from high-cost-of-living states or districts. Many of them are forced by practical economics to rent their homes while their family is in the DC area, while others choose to rent in the DC area while keeping their home available for trips back. Still others leave their families at home and sleep in their offices.
But courts have heard challenges based on residency over and over and have always ended up saying that a person in federal service and working in DC maintains the same residency that they had before they began working there. The same applies to the military. Your residency when you get out of the military is that same as when you entered unless you have officially changed it. This is how so many people, such as Colin Powell, can come out of a service career and not have to deal with establishing residency.
Unfortunately, judges are often political appointees and have political "debts" to pay.

Since Illinois law allows for people to serve in national government without losing their Illinois residency status, it can only be that the Appeals Court is execising a non-judicial agenda. The people should vote him out or in. It should not be decided by some legal trickery.

The Illinois Supreme Court currently has 4 democrats and 3 republicans. Two of which were appointed by Rahm's buddy, Blagojovich.
By the way, I think this is the same court that disallowed the subpeona's for Rahm and Obama in the Blagojovich corruption trials. It is also the same court that certified Roland Burris, the highest bidder, for Obama's seat.

The Law states a candidate must maintain OWNERSHIP of a local residence when away due to employment requirements [and maintain a voting record AND vote, which he did]. Emanuel leased his residence and didn't pass title with the leasehold he entered into. This ruling will NEVER stand, never, trust me.
C'mon, y'all---this is only an issue because Emanuel's a Democrat. I'm not a fan of his, but I'm not going to deny him the rights due any person serving their state and their country in D.C. Some of you seem to ignore the fact that before accepting the job in Obama's administration, Emanuel was an elected U.S. Representative for the State of Illinois. His residency in D.C. was directly related to his service in Congress. He did not buy a permanent residence in D.C., and he maintained a residence in Chicago, leasing it out while serving in Congress and the Obama Administration. Therefore, he was still legally a resident of Illinois. You can't rewrite the laws to suit you own poltical prejudices.
Using the logic some people are applying, any Congressman or Senator who buys a house in Virginia or Maryland while they're serving in D.C. has relinquished their home state residency and is serving illegally. That includes a number of Republican members of Congress--so you might want to rethink your position on this. I don't think the Constitutional revisionists are ultimately going to win this one.
It is good news for the citizens of Chicago. It is time that politicians have to prove that they live and work where the people they want to represent live and work. I live in CA and own two rental homes that I once lived in. Both are in different counties than the one I currently live in. I am not allowed to be a registered voter from either of those two counties I don't currently live in, so I can see how something as similar to this might apply to Rahm even though he's in a different state than me.
On another note, after reading his Bio. I see that he has not held any real job where he would have developed the skills necessary to run something as complex as Chicago city government. Just like his, Barry in that respect.

To me this issue is pretty cut and dried. The requirements to run for mayor are clear. You must have lived in Chicago for at least a year prior to the election to run. Emmanuel lived in Washington, not Chicago. He did not maintain a home in Chicago and did not reside there.
The facts that he was in Washington to serve the president and that he intended to return are irrelavent. The requirement is clear, and he didn't meet the requirement.
This is a victory for the rule of law. We have become a nation that is too quick to suspend the rule of law if something else seems to "make more sense" to us. Emmanual certainly knew the law and chose to gamble that he could get a "deferral" from it. Good for the court for sticking to the rules. It's nice to see the law prevail.

Not stirring the pot or taking a stand on this question, just curious to know how it should go under those circumstances. Keep in mind that even holders of public office are allowed to vote from their home precinct as evidenced when Barry and others went home to vote in November, 2011 as all federal elected officials do. Is the voting law and qualifications for holding local public office the same regardless if the person is elected or appointed?

This is not based on state or federal law, it is Chicago city ordinance that mayoral candidates must live in the city 365 days before the election. The arguement was made that if Rahm can run, then all the firemen, policemen, teachers, city workers, etc. who are required to live within city limits by city law would be able to leave the city and keep their jobs if they just rent their houses and say they "intended to return someday". Believe me, these people would love to move out and get their children out of Chicago public schools, stop paying Chicago city taxes and the new Cook Co sales tax.
The printer has already said the ballots are going to print without Rahm's name one them as today's court desicion is the current rule to follow. The ballots need to be printed and distributed to the polling places soon. This means Rahm can only get on the ballot now as a write-in since the election is Feb. 22. He may not even have time to file as a write-in because the election is so close.

@tiny-exactly my stepson now a marine was a correctional officer for the country in the state he lives in and he was required by that county to live within the county or lose his job.
@wpearson-as it relates to military personnel you have the same guidelines you must maintain a residence to continue voting in your state. If you are a single person you can list your parents address for that matter as your legal residence as long as you maintain receiving mail there as well and do not obtain a primary residence outside of that state/city/county. If you declare yourself a resident of another state by getting a drivers license or register to vote in another state your original state is no longer your residence. By law you as a member of the military can maintain a drivers license from your home state and your voting privileges but once you change them that's it you have to reestablish residency. So because Rahm changed his address, voting and is not military he would have been required to get a DC license he by doing that revoked his illinois residency. Temporary residency is listed as 6 months or less. Also I would guarantee he did not pay state income tax for illinois and that would be the nail in the coffin.......you aren't a resident if you don't pay state income tax. He would have paid property tax for the rental but not income tax on his large salary from DC. He would have had to pay tax then in both places which I am sure he did not given the people in DC tend to forget they are required to pay taxes like the rest of us. He most assuradly would not have paid in both places. So a quick look at his w-2 would answer the question as payroll doesn't deduct for two states for the same timeframe.
Based on this ruling, a military person would only be eligible to run if they had lived there for the 365 days prior to the election. The law is not in place to keep people from running, but rather to insure that those who run for elected offices are truly representing their geographic neighbors. The law seems to be enacted to insure that someone who is mayor Chicago has lived there for the year prior to being elected. This seems to make sense.

Double Jeopardy-what does this have to do with voting absentee ballot? You can only vote absentee ballot if you have not become/claimed residency elsewhere. There is a clear difference in Chicago between being eligible to VOTE and being eligible to RUN for office. If your government business takes you out of Chicago the law states that you can still VOTE in local elections. HOWEVER, the law sets a DIFFERENT standard for being able to run for office than it does for being able to vote. To run, you must have physically resided there for the year leading up to the election (which may be different than meeting the residency requirements for voting, which does make some allowances for being considered a resident without actually residing there.)
For those who consider the rule of law to be important, it looks like the court got it right.

It'll be interesting seeing what the Ill Sup Court does with this. The appeals judges (the two that overruled the trial court judge) must have had some legal basis for that decision.
I don't like to think that at the appellate level judges would render decisions for political reasons. (although that did happen ten years ago at our US Supreme Court).
A legal resident remains a legal resident until an irrevocable decision is made to relinquish that residence. It usually requires that the resident actually intends to relinquish same or that he/she does something that is irreconcilable with continued residency.
A president of the United States does not give up his Texas residence or citizenship just because he lives in DC for 8 years.
The Court evidently relied at least partly on Emmanuel's renting out his Chicago apartment while he was in DC but what difference does that make? Pretty clearly he did not intend to become a resident of DC and he didn't sell the apartment.
Those of you who think it obvious that he gave up his residence better think about that a little more if, for example, you have a child who is attending a college out-of-state. Or is in the Army stationed in Afghanistan.

2nd, if you go away to college and get a new license, you have set up a new residency. If you move your stuff out of your parents home and go to college, then they move out of state and rent their house, is that somehow still your residency even though you can't actually go into the house?

Mayors must follow the election laws of the city they want to be mayors of, senate candidates follow the election laws of the state they want to run in for the senate. Chicago election law is residency 365 days before the election. State election law is 30 days. Works the same in New York where Hillary carpet-bagged as senator the way Keyes tried to in Illinois. (We didn't forget the sneaky Democrats either.)

Openminded is right. During the thirty years that I lived in Chicagoland (Evanston), numerous attempts were made to pin corruption on Daley Father or Son and all failed. Don't think the watchdogs haven't been vigilant. However................many underlings have gone down for corruption, down to the minor inspectors. I remember when a newspaper opened a bar and recorded the city inspectors who came in demanding bribes to pass the electricity, plumbing, health, safety, rodent control, flood control, gas protection (structural and human), pigeon control...you name it. A few of the inspectors had to change their names or take a few days off.

I lived in Georgia for a year once, I was totally miserable. It has its good points but tolerance was not one of them. I figured being from South Carolina it would be about the same but I am from Charleston which is a very tolerant city (Maybe because it is an international port and tourist destination) I remember being appalled at the people in Gwinnett and (I forget which one but a county just north of Atlanta) where they openly detested blacks. At people in my own office in Buckhead who made racist comments all the time. Just disgusting.

I did not confront at work, but I did let it be known that I was for civil rights so that those who had a clue would stop including me in racist conversations. There are rules in every state for being elected to office. Hillary Clinton had to take up a residence in New York before she could run for office. Not that I am a fan of hers but the rules apply to all races period. There are age limitations as well as residency rules that apply to each candidate. For a congressional seat you must reside in the congressional district for a period of time before running for that and as for Senate you must reside in the state for a period of time. To be a state legislator there are the same limitations. Rahm is just trying to bully or whine his way through and hope that his liberal corrupt buddies will help him break the rules. I guarantee you that if say, he was alllowed on the ballot, won the election and then when the next election came up if someone else tried the same thing he would be fighting like hell in court to make sure they weren't allowed to run. He like many others are playing the race card when it isn't even in play since the rules apply to EVERYONE on the ballot........they were all required to meet that standard as well.

By NOT renting it out and by maintaining the home and the bills for maintaining it in his name, he would have had a basis to claim he lived in Chicago and worked in Washington. Unfortunately, he rented it out until he wanted to run for city office. That negates his residency until he re-establishes it as he did Oct, 2010. There are many things in life that you MUST prove residency ... and to do so, rules have been created so that you can. Different circumstances require different lengths of residency ... the college:2 yrs in MA & registering to vote: usually 60 days nationwide.
I move to CA in 1980. I moved to CA in October. The federal presidential election was in November. Since my spouse and I would not meet the 2 month residency requirement to register to vote, we had to arrange for "absentee ballots" from MA since we were still considered MA residents for that election (not for tax purposes or anything else, but for election purposes to guarantee we were NOT disenfranchised). We also had to ensure our car insurance for CA residents was enforce within 30 days of "establishing" residency, which is the day we physically moved there.
Residency for election purposes is merely ONE OF MANY reasons anyone must establish residency. Chicago requires 1 full year minimum ... had he not forfeited his residency to rent his place out for 2 yrs and had maintained the cost of maintaining the residence in his name while working in Washington, he would have maintained his Chicago residency while working in Washington, DC. Do NOT give anyone crap that he is a middle class or blue collar worker either ... he has been making a substantial income as a politician for YEARS before even being tapped on the shoulder by Pres Obama. He made choices that were not good for his other choices ... and just like someone who over extends himself on a mortgage he cant afford, he must deal with the consequences of his choices. He isnt too big to fail that he needs special laws to "prop him up" while he makes the wrong decisions for his future choices.
I find it unique that my U.S. Representative owns a home three blocks from mine which his wife and kids live in year round. He travels back and forth when the House is not in session and maintains his residency here in his state from which he was elected. He also votes in the same polling booths we all do here.
There are any number of members of Congress whose families live with them in the DC area. Are you saying they aren't residents of their states and are serving illegally? Some of them have lived in the DC suburbs for years and rarely return to their home state "residences". Their children can get in-state college tuition in Virginia (where most of them live). I would think renting their unused homes would make both fiscal sense, and living in DC also would be healthier for the families that don't live within an easy commute. It is also pragmatic, since the cost of DC housing is astronomical.

It is a great loss for the people.
Chicago would have benefitted from his wisdom and connections. I know a lot of people do not like him because he is a "hardball" politican, but that strength would make him more able to keep Chicago at the forefront of the world.
All of the other candidates, put togther, do not have as much knack for brokering political solutions, making the hard decisions and standing up to other units of government (state, federal) for the people of the city.
While I am sure his enemies will rejoice in this ruling, the truth is Chicago loses from not having the best man for the job even considered for the job.

People have been calling names at Chicago since Kennedy won in 1960, but honestly, Chicago is less corrupt than most other cities its size. Neither Mayor Daley ever committed crime, and while some aldermen have been charged with political misdeeds, its not the norm at all.

And why is any of that pertinent to Rahm Emmanuel's candidacy? He has never done anything wrong, so what's your beef? He's effective at getting things done for his constituents?
